Rape victim called willing at trial

of 5 inmates of County Jail

A 22-year-old man who said he was raped by five fellow inmates in Cuyahoga County Jail was a homosexual who had sexual relations voluntarily, a common pleas jury was told yesterday.

The five are on trial before Common Pleas Judge Perry B. Jackson in the

Mott Building, 220 St. Clair Ave. NW.

Dr. Stacey A. Besst, jail physician, testified earlier he examined the man who brought the charges on Jan. 20 and determined he had recently had sexual relations.

Darryl Richardson, now imprisorned in the Ohio

Reformatory, Mansfield, for aggravated robbery, said the man voluntarily had relations with him in the jail that morning.

Richardson was not accused of participating in the attack that reportedly occurred later that day.

Richardson was the last defense witness. Closing

arguments will start this morning.

On trial are Michael Eaton, 20, of 9903 Pierpont Ave. NE; Ralph Wells, 23, of 1236 Bender Ave., East Cleveland; James L. Carr, 23, of 12204 Mt. Overlook Rd. SE; George Britton, of 1134 E. 141st St., and Ervin Green, 25, of 3443 E. 140th St.

Pupils from Mayfield High School have observed the trial daily as a senior history project.
